1. Acceptance of Terms

By creating an account, accessing, or using SiteArche, you enter into a legally binding agreement to comply with these Terms of Service. If you disagree with any portion of these terms, you are strictly prohibited from using our platform, services, AI tools, or web hosting infrastructure.

2. Geographic & Territorial Restrictions

SiteArche services, website building tools, web hosting, digital utilities, and marketplace operations are available worldwide, with the explicit exception of Israel. Access, registration, account creation, site hosting, API integration, or use of any SiteArche services by individuals, citizens, residents, corporate entities, or IP addresses originating from or operating within Israel is strictly prohibited. Any accounts, hosted content, or transactions identified as originating from or affiliated with Israel will be terminated immediately without prior notice, recourse, or refund.

3. Eligibility & Account Responsibilities

You must be at least 13 years of age (or the minimum legal age of majority in your jurisdiction) to use SiteArche. You are fully responsible for maintaining the security of your account credentials. Account sharing, multi-account registration to exploit free tiers or promotional quotas, and unauthorized access attempts are strictly prohibited. We reserve the right to suspend or terminate accounts that breach security guidelines.

4. Web Hosting & Resource Usage

SiteArche provides web hosting, site builder tools, and related services under fair usage standards. You agree not to misuse server infrastructure, host malicious code, execute unauthorized automated file-sharing or scraping scripts, or excessively consume bandwidth and server resources. SiteArche reserves the right to throttle, restrict, or remove hosted content that compromises infrastructure performance or network security.

5. Prohibited Content & Conduct

You may not use SiteArche to generate, store, host, display, or transmit content that is unlawful, defamatory, abusive, fraudulent, violent, discriminatory, or infringing upon third-party intellectual property rights. Spamming, phishing, distributing malware, reverse engineering platform components, or attempting to bypass platform security measures will result in immediate termination and potential legal action.

6. AI Tools & Content Disclaimer

All Artificial Intelligence tools and generation capabilities on SiteArche are provided strictly on an "as-is" and "as-available" basis. Users maintain sole responsibility for inspecting, editing, verifying, and ensuring the legal compliance of all AI-generated copy, visual assets, and code prior to publication. SiteArche disclaims all liability for third-party copyright claims or damages resulting from AI outputs.

7. Marketplace, Gigs & Escrow Workflow

Sellers must deliver products and services matching their advertised specifications. Buyers are required to provide clear, complete project requirements prior to order initiation. All marketplace transactions are governed by SiteArche's escrow system: funds are held securely and released to the seller only after explicit buyer approval or finalized dispute resolution. SiteArche dispute team decisions are final and binding.

8. Payments, Platform Fees & Refunds

SiteArche collects a standard 10% platform commission fee on completed marketplace orders. Subscription plans, template purchases, and activated service packages are strictly non-refundable once billed or processed. Authorized withdrawal requests are processed within 1 to 2 business days, subject to mandatory identity and compliance verification.

9. Intellectual Property Rights

SiteArche retains all right, title, and interest in its proprietary platform architecture, source code, visual design assets, software tools, and templates. Users retain ownership of their original uploaded content, granting SiteArche a limited, non-exclusive license to host, transmit, and display such content solely as necessary to operate the services.

10. Limitation of Liability

To the maximum extent permitted by law, SiteArche, its operators, officers, and affiliates shall not be liable for direct, indirect, incidental, consequential, or punitive damages resulting from downtime, data loss, service interruptions, marketplace dispute outcomes, or AI-generated output inaccuracies. Our cumulative financial liability is strictly limited to the amount paid by you for platform services in the billing cycle preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless SiteArche, its administrators, and infrastructure providers from any claims, liabilities, losses, damages, legal costs, or fees arising from your violation of these terms, your hosted websites, or your misuse of the platform services.

12. Termination & Account Deletion

SiteArche reserves the right to suspend or terminate accounts and remove hosted content at any time, without prior notice, for violations of these terms or behavior detrimental to system stability. You may request full account deletion at any time by contacting support.

13. Modifications to Terms

We reserve the right to revise or update these Terms of Service at any time. Any changes take effect immediately upon posting to the platform. Continued access to or use of SiteArche following updates signifies complete acceptance of the revised terms.
